Laconia Pumpkin Festival - Vendor Agreement

  3. We are happy you will be joining us as a vendor for this year’s Laconia Pumpkin Festival! Please review the information below, and sign at the bottom of the form before submitting.
  4. We will notify you as to your designated arrival, drop off and set up times once they are determined. These times are scheduled to keep drop off and set up congestion to a minimum. Food vendors must be present and be ready for inspection by the City at the time provided to you. You will be sent your location, and set-up time via email approximately 10 days before the Pumpkin Festival. When you arrive to check in at the Festival, you will receive your booth location and instructions regarding how to access your space.
  5. Each vendor will be granted a certain number of square feet; no additional tent space or grounds space will be allowed. Vendors are responsible for providing their own tents, canopies, chairs, etc. Vendors may not sublet or share their space. Tents or canopies must have 40 pounds of weight on each frame leg. Staking into the pavement is not allowed. No electricity is available at the festival site.
  6. When vendors arrive for booth set up they will be instructed to drive to their booth location, unload, and immediately move their vehicle (unless you are a food truck, etc.). You will be directed to a location for vendor parking.
  7. You are required to list all of the items you propose to sell and/or exhibit at the Festival on your application. If a conflict exists with another vendor regarding an item or service/activity not listed on your application, you will be required to remove it from your booth. Laconia Pumpkin Festival does not guarantee product exclusivity, but we will work to allow a limited number of any type of goods to ensure a variety. Vendors may not display, offer for view or sale any illegal or contraband items. Vendors are solely responsible for the security of all items in their booth at all times.
  8. Vendors shall provide a Certificate of Insurance providing proof of Commercial General Liability of $1,000,000 per occurrence and $2,000,000 aggregate. Vendors shall also name the City of Laconia, its officials, agents, employees and volunteers as additional insured on the General Liability policy on a primary and noncontributory basis.
  9. The vendor agrees to defend, indemnify and hold harmless Laconia Pumpkin Festival and the City of Laconia, its officials, employees and volunteers) from and against any claims, demands, suits, actions or proceedings seeking damages, costs, fees, penalties, interest, equitable relief or any other relief on account of bodily injury, death, personal injury, economic injury or property damage arising from its acts, omissions, services, products or operations in connection with or in relation to vendor’s participation in the Laconia Pumpkin Festival. The vendor shall be financially responsible for any damage that occurs to its property and waives any property damage claim that may arise against the Laconia Pumpkin Festival or the City of Laconia.
  10. Vendors are expected to operate during the duration of the Festival hours, rain or shine. Vendor booths must remain open and staffed during festival hours (unless prior approval has been received from the Festival organizers). Most streets in the Festival area are closed during operating hours which makes it difficult for vendors to leave early in most cases.
  11. During Festival hours vehicles will not be allowed in the Festival area for restocking or resupplying of goods.
  12. Vendors are not allowed to operate music or public address systems on the Festival site without prior approval from the Festival organizers.
  13. Vendors are expected to clean up their area regularly during the Festival and thoroughly at the closing of the Festival; if this is not done you will not be invited to participate in future Pumpkin Festival events. Vendors must carryout all trash or dispose of it in Festival dumpsters (we will let you know the dumpster location). Please do not use the trash barrels placed throughout the Festival for vendor trash; these are for the use of our Festival attendees. All booths and materials must be removed within four hours of the close of the event (unless prior approval has been received from the Festival organizers).
  14. If for any reason you cannot make it to the event, it is your responsibility to inform us as soon as possible. Please contact us by email at nbrown@laconianh.gov, or call Nancy Brown in the Laconia City Manager's Office at 603-527-1270. A refund will only be given for any request received by Laconia Pumpkin Festival by September 1, 2026, and only if we are able to fill the space with another vendor. No refunds will be given for any request received by Laconia Pumpkin Festival after September 1, 2026. No refunds will be given to vendors who may not operate due to failure to satisfy or comply with local health and safety codes.
  15. This agreement has been read, understood and entered into freely and voluntarily by the vendor below. Please be sure to sign and date this agreement. Laconia Pumpkin Festival reserves the right to reject any application.
  16. Electronic Signature Agreement

    By checking the "I agree" box below, you agree and acknowledge that 1) you agree to all terms and conditions outlined in this agreement, 2) your application will not be signed in the sense of a traditional paper document, 3) by signing in this alternate manner, you authorize your electronic signature to be valid and binding upon you to the same force and effect as a handwritten signature, and 4) you may still be required to provide a traditional signature at a later date.
